Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the websites, dashboards, application programming interfaces, software, and managed infrastructure services (collectively, the "Services") provided by Vintony Host ("Vintony Host", "we", "us", or "our"). By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and "you" refers to that entity. If you do not have such authority, or you do not agree with these Terms, you must not accept the Terms and you may not use the Services.
2. Your account
You must provide accurate, current, and complete information when registering for an account, and keep that information up to date. You are responsible for all activity that occurs under your account, including activity by users you authorise.
You must keep your credentials confidential, choose a strong password, and enable available security features such as two-factor authentication. You must notify us promptly at support@vintonyhost.com if you discover or suspect any unauthorised use of your account.
You must be at least 16 years of age, or the age of majority in your jurisdiction, to use the Services. The Services are not directed to children.
3. Acceptable use
You may not use the Services to host, transmit, or distribute content or applications that are unlawful, infringing, defamatory, abusive, fraudulent, or that violate the rights of any third party. Specifically prohibited activities include, without limitation:
• Distributing malware, ransomware, phishing kits, or content used to facilitate unauthorised access to other systems; • Sending unsolicited bulk email or operating mail servers that breach anti-spam laws (CAN-SPAM, GDPR ePrivacy, etc.); • Hosting content that depicts child sexual abuse, incites violence, or violates applicable export-control or sanctions law; • Mining cryptocurrency on shared or unmanaged plans without prior written consent; • Resale of credentials, virtual machines, or service quotas to third parties.
We may suspend or terminate Services that we reasonably believe violate this section, with notice except in cases of immediate harm. Where practicable we will provide you an opportunity to remediate the issue.
4. Pricing and billing
Fees for the Services are described on our pricing page and are payable in advance on a monthly or annual cycle. Pricing is in United States Dollars (USD). Taxes (including VAT where applicable) will be added at checkout based on your billing location.
Annual subscriptions are discounted from monthly equivalents and renew automatically at the end of each term. You may cancel auto-renewal at any time from your dashboard; cancellation takes effect at the end of the current term.
Failed payment notices will be sent before service is suspended. If payment cannot be collected after three retry attempts over five business days, the affected Services may be suspended and, after a further fourteen days, terminated and erased.
5. Refunds and 30-day money-back
First-time purchases of shared, VPS, and managed cloud plans include a 30-day money-back guarantee. To request a refund, contact hello@vintonyhost.com within 30 days of your first purchase. Refunds are issued to the original payment method within 5–10 business days.
Dedicated server orders, domain registrations, and SSL certificates are non-refundable once provisioned, in line with industry standard practice and the underlying vendor terms.
6. Service-level commitment
Our uptime commitments and service-credit ladder are published at https://vintonyhost.com/sla. Service credits are applied automatically to the next invoice and represent your sole and exclusive remedy for missed availability targets, except where prohibited by applicable law.
7. Customer content and intellectual property
You retain all rights, title, and interest in the data, files, code, and other content you upload, run, or transmit through the Services ("Customer Content"). You grant Vintony Host a limited, non-exclusive licence to process Customer Content solely as needed to deliver, maintain, secure, and improve the Services.
All other rights in our software, dashboards, documentation, and brand are retained by us or our licensors. Nothing in these Terms transfers ownership of our intellectual property to you.
8. Restrictions
You will not (a) reverse-engineer or attempt to discover the source code of any non-open-source portion of the Services; (b) resell or sublicense access to your account except as expressly permitted by your plan; (c) probe, scan, or otherwise test the vulnerability of the Services without our prior written consent (security disclosures via security@vintonyhost.com are explicitly welcomed); or (d) use the Services to build a competing product.
9. Suspension and termination
Either party may terminate these Terms by closing or deleting the customer account, subject to (in the case of paid plans) any prepaid term. We may also terminate or suspend the Services immediately, without notice, if we reasonably determine you have materially breached these Terms (including the acceptable-use section) or if continued provision of the Services creates a legal or security risk.
Upon termination, your Customer Content will be retained in encrypted form for 30 days to allow recovery, after which it will be permanently erased. Backups follow the same window unless a longer retention is contractually required.
10. Disclaimer of warranties
The Services are provided "as is" and "as available". To the maximum extent permitted by applicable law, Vintony Host disclaims all warranties, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Services or these Terms is capped at the greater of (a) the amount you paid us for the Services in the 12 months preceding the event giving rise to the claim, or (b) USD 100. Neither party is liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenue, or data, even if advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, or for fraud).
12. Indemnification
You agree to defend, indemnify, and hold harmless Vintony Host, its officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from (a) Customer Content; (b) your use of the Services in breach of these Terms; or (c) your violation of applicable law.
13. Force majeure
Neither party will be liable for delays or failures in performance caused by events beyond their reasonable control, including without limitation natural disasters, war, terrorism, civil unrest, governmental action, labour disputes, or large-scale internet failures. The affected party will resume performance as soon as reasonably practicable.
14. Modifications to the Services and these Terms
We may update the Services and these Terms from time to time. Material changes will be notified by email or via the dashboard at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms; if you do not agree, you may terminate your account before the effective date.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that we may seek interim or injunctive relief in any court of competent jurisdiction to protect our intellectual property or confidential information.
If you are a consumer based in the European Union, you retain the benefit of any mandatory consumer protection rules in your country of residence.
